These terms and conditions govern your use of and access to everything herein Noshe-Jan platforms including but is not limited to content, products, services, resources, materials, information and company branding.

These terms and conditions apply whenever you access any of Noshe-Jan platforms regardless of how you do so. By accessing and using Noshe-Jan platforms you, the user agree to be legally bound by these terms and conditions.

to harm, abuse, harass, threaten, stalk, intimidate or offend any person or entity
to publish or facilitate the publication of personal information of a third party without their consent
make remarks, claims or statements that do not reflect your honest views and experiences
to publish or facilitate publication of material for which you do not have ownership, title, or consent from the owner or title holder to do so
to build a competitive products, service or platform
to publish or facilitate the publication of pornographic or offensive material
to publish or facilitate publication of material including viruses or other computer code, files, or programs designed to interrupt or damage the functionality of computer software or hardware
to publish or facilitate publication of advertising material for yourself or any other party except as expressly authorized by us

Breaching these rules of conduct may result in termination of your access to this website and the prevention of further access without warning or notice. You alone are responsible for the content and consequences of any of your activities.

Social Media

Sharing, posting & linking about Noshe-Jan platforms and anything contained herein Noshe-Jan platforms is permitted provided that Noshe-Jan is clearly attributed (given credit) and direct post / page to Noshe-Jan platform URL on related topic is clearly acknowledged and provided.

Resources / Materials

You may access, download, or print resources and materials from Noshe-Jan platforms for your personal use only. Sharing / using any resources any materials from Noshe-Jan platforms for commercial use of any sort without permission is prohibited.

All but is not limited to resources, materials, documents, links, information purchased or provided for purchased services are strictly for the intended recipient and prohibited from being disclosed, copied, shared or distributed. All interests must be reflected to Noshe-Jan and purchased from Noshe-Jan directly.

Photography / Video Recording

Participants are welcome to use a camera for photos during online and physical classes or bookings however other participants, Noshe-Jan and its chef or mentor privacy must be considered.

Video during online and physical classes is not permitted except as expressly authorized by us prior to class. Please email permissions@cookingwithnoshejan.com if you require permission, a minimum of 72 hours prior to class or booking response time is required.

Online class participants are welcome to have their video call camera on during online call for the class however recording the call is not permitted.

Noshe-Jan and its chef or mentor reserve the right to revoke permissions at anytime prior or during the class or booking without notice at it’s sole discretion.

Noshe-Jan and its chef or mentor conducting class reserves the right to record online and physical classes. This is done so with Noshe-Jan, Noshe-Jan chef or Noshe-Jan mentor pinned to view rather than participants.

Moral Rights

All including but is not limited to content, resources, materials, products, services, information and all other work on Noshe-Jan platforms are protected under moral rights defined under the copyright Act. You are legally obligated to attribute Noshe-Jan and treat Noshe-Jan’s work with respect.

You must:

Attribute (give credit to) Noshe-Jan
Not say a person is a creator of Noshe-Jan’s work when they’re not
Not do something with Noshe-Jan’s work (such as change or add to it) that would have a negative impact on Noshe-Jan’s reputation

Ownership / Copyright

All content and work on Noshe-Jan platforms including but is not limited to free and purchased resources, materials, documents, partner content, third party content, software, logos, company branding, text, graphics, images, photographs, videos, audio, illustrations, themes, objects, stories, concepts, artwork and all other content and work are intellectual property of Noshe-Jan and protected under Australian and international copyright laws.

You may not use, copy, display, distribute, modify, translate, transmit, reproduce, republish, reformat, incorporate into advertisements and other works, promote, creative derivative works, or in any other way exploit or allow others to exploit any of Noshe-Jan platforms content and all other work in whole or in part except as expressly authorized by us. Please email permissions@cookingwithnoshejan.com if you require permission, a minimum of 14 day response time is required.

Permissions

For permission requests email: permissions@cookingwithnoshejan.com Noshe-Jan will respond to your email with either a permission granted email to give you authorisation or may respond with a permission denied email depending on the decision of Noshe-Jan. Depending on factors including but is not limited to the time frame your request for permission is received or other factors Noshe-Jan may not respond to your email, in this case your request for permission has automatically been denied. Sending an email requesting permission does not automatically give you authorisation. Noshe-Jan, chef and mentor reserve the right to revoke permissions at anytime without notice at it’s sole discretion.

Third Party / Partner Content

In addition to partner content and submitted content Noshe-Jan platforms may also include or link to other content or information provided by or about third party including but is not limited to websites, products, services, activities, resources, materials or events (collectively “third party content” or “partner content”). Noshe-Jan takes no responsibility for third party or partner content. Your interaction with or correspondence with the providers of third party or partner content are solely between you and the third party or partner providing it. Noshe-Jan does not control or endorse and makes no representation or warranties regarding any third party or partner content, and your access to and use of such third party or partner content is at your own risk.

Contributing Content / Submissions

Some of our services on Noshe-Jan platform are designed to let you upload, submit, store, send, receive, or share your information, content or submission. You have no obligation to provide any information, content or submission to our services and you’re free to choose the information, content or submission that you want to provide.

If you choose to upload or share any information, content or submission you grant Noshe-Jan permission to use your name in relation to your contributing information, content or submission and you agree to make sure that it is lawful and that you have the necessary rights to do so. Noshe-Jan takes no responsibility for any contributing information, content or submission.

Copyright Infringements

Noshe-Jan respects the intellectual property rights of others. Any content found within Noshe-Jan platforms that infringes upon the copyright of any entity outside of Noshe-Jan has not been done so intentionally. If you believe that there is material on Noshe-Jan platforms that infringes third-party intellectual property rights, please email admin@cookingnoshejan.com with sufficient information to enable us to determine who the owner of the intellectual property is and to remove it from Noshe-Jan platforms if appropriate. It is required that the party alleging copyright infringement must provide a reasonable opportunity for the alleged infringer to cease the infringing activity before any legal claims for damages can be initiated.

Accounts

When applying or registering for a account or subscription on any Noshe-Jan platform you agree:

to provide accurate, current and complete information and promptly update your registration data in the event of a change of such registration data including but is not limited to name change, credit / debit card, other payment account information, contact details and other as necessary
you will be responsible for all activities that occur under your account

not to share your account details and password with anyone
to notify Noshe-Jan immediately of any unauthorised use of your password or any other breach of the security of your account
not to apply or register for an account if you are barred or suspended from using any Noshe-Jan platforms under any applicable law or by Noshe-Jan
not to open an account using anyone other than your or false information

Noshe-Jan reserves the right to cancel accounts or subscriptions at any given time without notice.

Payments

All orders on Noshe-Jan platforms must be pre-paid in full prior to fulfillment. In the case you pay for an order with your credit card, we do not store your credit card details on our servers however it may be retained by our payment gateway provider in circumstances where this is required. You agree that Noshe-Jan takes no responsibility for your credit card details and you agree to take full responsibility of sharing your credit details. In cases where your payment for an order fails for reasons including but is not limited to insufficient credit card, cheque or other payment method dishonour we do not warrant that stock will be held until an alternative payment method is available or the original payment method is made to function.

Prices

Prices for products or services owned by Noshe-Jan on Noshe-Jan platforms are displayed in Australian dollars (unless otherwise marked) including GST (if applicable to the product).

In some cases, the Noshe-Jan platform may determine that you are in a foreign country and may display prices to you without GST and / or in the alternative currency.

This is not in the control of Noshe-Jan and you agree to be aware of the price, currency and inclusion of GST prior to making purchases.

Participant / Purchaser Cancelation Policy

Please be aware that including but is not limited to products, services, vouchers, content, resources, materials, class and all other purchaser on Noshe-Jan platforms are non-refundable.

Please appreciate the impact changes have on small businesses and the difficulty of on-setting last-minute places. Refunds are not provided for cancellation of class, cancellation of booking, products, services, resources, materials and all other purchases unless purchase is faulty and cannot be replaced. Noshe-Jan reserves the right to determine the eligibility of a refund.

Rescheduling requests received more than 14 days of your class or booking date and time are entitled to reschedule into another available class or booking with no cost.

Rescheduling requests received between 14 days and 7 days less of class or booking date and time will incur a 30% charge to reschedule into another available class or booking.

Rescheduling request received between 6 days and 2 days less of class or booking date and time will incur a 50% charge to reschedule into another available class or booking.

Your purchase will be deemed forfeit and no rescheduling will take place if you:

Request to reschedule within 2 days of class or booking date and time
Fail to arrive / attend to the class or booking at the reserved time
If you voluntarily leave the class or booking after it has commenced
If you need to leave or cannot attend the class or booking for reasons of bereavement, injury or illness

We cannot accept responsibility for changes in peoples work commitments, other commitments, itineraries, for sickness including COVID related illness or for any other changes.

You are welcome to send someone else in your place for your class or booking however prior to commencement of class or booking we will require notification within reasonable time to change the class or booking attendee details and forms for the person taking your place.

The same terms and conditions apply for in person or online classes or bookings and if you have booked / purchased through the redemption of a gift voucher.

Noshe-Jan reserves the right to change these terms and conditions for classes or bookings impacted by government regulations and restrictions.

Noshe-Jan Cancelation Policy

Noshe-Jan reserves the right to reschedule a class if but is not limited to:

Minimum number of participants is not reached. A minimum of participants is required to run a scheduled class
Illness and other matters effecting Noshe-Jan

Noshe-Jan reserves the right to make the decision of setting a future class or booking date and time, credit or refunding. Participants will be notified as soon as possible prior to class or booking date and time.

Affiliate

DISCLAIMER: YOU SHOULD ALWAYS CARRY OUT YOUR OWN INVESTIGATION BEFORE BUYING PRODUCTS OR SERVICES FROM ANYONE VIA THE INTERNET. THIS INCLUDES PRODUCTS AND SERVICES SOLD ON NOSHE-JAN PLATFORMS AND ALL OTHER WEBSITES.
